EB-5 Investment about to go up close to $1 Million or more

USCIS will publish it’s Final Rule the next 1-2 weeks in the Federal Register finalizing the new investment amount limits for EB5 and other new regulations to the program. The rule RIN: 1615-AC07 which completed OMB Review on June 27 2019 is being touted as a modernization of the EB5 program.

For now, we know that the investment limits will be increased drastically as SUCIS has contended that the $500,000 investment amount originally set in 1990 has never been increased taking into account inflation among other factors.

Once the Rule is published, It can take upto 30-60 days for them to be effective. For now, we can only go by what USCIS has released in the past, we don’t know if they have made any modifications to those proposals. In Jan 2017, USCIS proposed increasing the Investment amounts from $500,000 to $1.35 Million for TEA investments and the $1 Million investment amount increases to $1.8 Million for non-TEA projects.
